The assailants who planned the attack have been arrested, and the main reason behind the attack is said to be Baba Siddique's close ties to Bollywood actor Salman Khan and alleged connections to underworld figures like Dawood Ibrahim and his crime network. Punjab CM's surrender to Delhi Durbar? Why?

Recently, Arvind Kejriwal, the chief of Aam Aadmi Party (AAP), influenced changes in Punjab's leadership. These changes include the appointment of KAP Sinha as the new Chief Secretary of Punjab, replacing Anurag Verma. 

Additionally, there was a cabinet reshuffle in the Bhagwant Mann-led Punjab government, with five MLAs inducted as cabinet ministers. Since Arvind Kejriwal's release from jail, the Punjab government has seen several changes. Four ministers were dropped from the Cabinet, and five new faces were inducted. 

The removal of several officials, including Baltej Pannu, Rajbir Singh, and Manpreet Kaur, from their posts in the Chief Minister's Office (CMO) has been seen as a move to tighten control over the Punjab government. The appointment of Aadil Khan as Special Media Advisor to the CM has further fueled speculations about the increasing grip of AAP's top leadership on the state government. These developments have led to accusations that the Punjab government is being remote-controlled to extract money for the upcoming Delhi elections. However, it is crucial to note that these changes may also be part of a broader effort to stiffle the working of the Punjab government and minimize the role of Bhagwant Mann in day-to-day decisions by autocratic Kejriwal, who is himself on the radar of courts and was in jail under court orders.

Additionally, two of the CM's aides, Onkar Singh and Navneet Wadhwa, were removed. 

Kejriwal, former Delhi CM but now just an MLA, in Sonia Gandhi style and blatantly unconditional manner reviewed the performance of Punjab Cabinet ministers in Delhi and set "targets" for them. He held one-to-one meetings with all Punjab ministers except the Chief Minister Bhagwant Mann. Meanwhile, CM Mann, who had called a Cabinet meeting at Jalandhar, the same time and later in Chandigarh, was forced to reschedule it due to the ministers' presence in Delhi Durbar of Kejriwal. Was this exercise aimed at securing funding for the upcoming Delhi elections, or was it to assert Kejriwal's supremacy or humiliate and subdue Bhagwant Mann for not showing enough sycophancy during Arvind Kejriwal's jail term?

Ambedkar had to wait until 1990 to receive the Bharat Ratna. Emphasizing the importance of continuing his legacy serves as a reminder for modern India. The National Judicial Appointments Commission (NJAC) was established to appoint and transfer judges to the higher judiciary to increase transparency and accountability. However, the Supreme Court struck down the NJAC Act, declaring it unconstitutional and violating judicial independence. The Court objected to the NJAC's composition, which included politicians and the law minister, citing potential political interference in appointments. Critics argued that the verdict protected the judiciary's opaque appointment system, perpetuating a "judges-selecting-judges" approach, and undermining efforts to increase accountability and transparency. Dr. Ambedkar advocated for a fair and transparent system in judicial appointments, balancing independence with accountability.

In contrast, granting bail to those accused of corruption and terrorism for political reasons erodes the rule of law and public safety, echoing the concerns raised by the NJAC controversy. This trend sets the stage for total anarchy, prioritizing political convenience over accountability and justice. Rajya Sabha Chairperson Jagdeep Dhankar strongly criticized the Supreme Court's 2015 verdict on the National Judicial Appointments Commission (NJAC) in his maiden address as chairman on December 8, 2022. He termed the verdict a "glaring instance of severe compromise on parliamentary sovereignty and disregard of the people's mandate," emphasizing the need to respect the will of the people and the primacy of Parliament.

Dhankar argued that the NJAC was a much-needed and historic step, receiving unprecedented support in Parliament. The Lok Sabha passed it unanimously, and the Rajya Sabha passed it with only one abstention. Additionally, 16 state assemblies supported the NJAC through legal proceedings, and the President of India approved the bill. However, the decision to strike down the NJAC Bill has sparked controversy and debate. Critics argue that the Supreme Court's decision is an attempt to maintain its power and vested interests, rather than serving the people's best interests. Dhankar stated that Parliament's sovereignty is "inviolable" and that the NJAC verdict needs to be reviewed. A fundamental principle of democracy is that parliament is responsible for making laws, while the judiciary's role is to interpret and implement them. This is echoed by Justice Felix Frankfurter, who said, "The Court's authority depends on the legitimacy of its decisions in the eyes of the people" (US Supreme Court, West Virginia State Board of Education v. Barnette, 1943).

Moreover, international examples demonstrate the successful implementation of similar reforms. The 2005 Constitutional Reform Act in the UK established the Judicial Appointments Commission, while judgments of the US Supreme Court also support the principle of parliamentary sovereignty.


Dr. Ambedkar's Vision for Judicial Appointments: Independence, Fairness Transparency, and Accountability

He advocated for a system where judges would be appointed based on merit. Dr. Ambedkar's speeches and interventions in the Constitutional Assembly debates reflect his concern for balancing judicial independence with executive accountability in appointing judges. His speeches and interventions in the debates of the Constitutional Assembly are recorded in the "Constitutional Assembly Debates" (CAD) volumes. On June 21, 1947, in Volume III, pages 448-449 of CAD, Dr. Ambedkar emphasized the significance of judicial independence and the necessity of a fair and transparent process when discussing judicial appointments. On 24.09.1947, in Volume IV, pages 223-224 of the Constituent Assembly Debates, Dr. Ambedkar deliberated about the role of the Chief Justice in appointing judges. He explained that while the Chief Justice should have a say in appointing judges, he highlighted the need for executive oversight to prevent the judiciary from becoming too powerful. In the book "CAD, Vol. VII," pages 540-541, the date 04.11.1948 is mentioned. Dr. Ambedkar addressed concerns about potential biases in judicial appointments. He acknowledged that the Chief Justice, like any individual, may have personal biases and prejudices. He stressed the need for a fair and transparent process to mitigate these risks and ensure that judges are appointed based on merit.

Indian Traditions, Norms, and Conventions: Shaping Judicial Powers

Rig Veda (Sukta 5.55.1) states: "यथा जनः तथा राजा" ("Yatha janah tatha raja"), meaning "As are the people, so is the king." This emphasizes the king's reflection of the people's values in dispensing justice. The relationship between the ruler and the ruled is of paramount importance. The Mahabharata (Shanti Parva, 67.23) declares: "If the people are the true rulers of the earth, then there is no higher authority beyond them." (Source: "यदि जन्ता जनार्दनः स्यात्, तदा नास्ति कश्चित् प्रभुः"). This concept is reflected in various traditions such as 'Panj Pyare' and "Sarbat Khalsa" in Punjab and Sikh traditions, and "Panchayat" in general.

Bail for those accused of corruption and terrorism; are there any parallels?

Amid discussions about Deep State agents, granting bail to individuals facing serious charges like corruption or terrorism solely for political reasons raises concerns about undermining the rule of law and compromising public safety. Experts and scholars argue that doing so would be a clear attempt to prioritize political convenience over accountability and justice.

Internationally, renowned democracies prioritize safeguarding citizens' rights and upholding public trust in institutions. Granting bail to individuals facing serious charges would be viewed as a gross miscarriage of justice, sending a dangerous message that those with political power or influence are above the law. 
Examples from vibrant democracies demonstrate this. Rod Blagojevich (USA), the former Illinois Governor, was denied bail on corruption charges. Marine Le Pen (France) was charged with embezzlement and misuse of public funds but was not granted bail to campaign. Former President Lula da Silva (Brazil) was imprisoned on corruption charges and denied bail to run in the presidential election.

As aptly stated by Yale Law Professor Judith Resnik, "Bail should not be used as a tool for political advantage; it undermines the integrity of the justice system." Ian Buruma, Author and Journalist, concurs, "Allowing candidates to campaign from prison would be a mockery of democracy and the rule of law." Anne Applebaum, Author and Historian, warns, "This would be a violation of democratic norms and would undermine trust in institutions." Ahmed Rashid, Author and Journalist, emphasizes, "Granting bail to terrorism accused can compromise national security and undermine counter-terrorism efforts." 


Conclusion

The gravity of granting bail to individuals accused of corruption and terrorism solely for political purposes cannot be understated. This alarming trend paves the way for total anarchy, fostering a perilous environment where those with political influence are perceived to be above the law. Such a scenario not only emboldens criminal elements but also jeopardizes the safety of citizens. Unless this issue is addressed effectively, it has the potential to lead to a complete breakdown of law and order, plunging India into chaos and anarchy. Solidarity for Change: Mamata Banerjee Government Under Fire Over Doctor's Brutal Murder

 A nationwide movement, spearheaded by doctors and backed by a broad spectrum of society, has emerged in response to the gruesome murder of a woman doctor. This horrific crime sparked widespread protests and repeated strikes by medical professionals, demanding enhanced safety measures for women. In Kolkata and West Bengal, vast crowds march through the streets, demanding justice and carrying candles, clay lamps, and signs that read "We want justice" and "Let there be light, let there be justice". The protests gained momentum with human chains formed to "reclaim the night", accompanied by flaming torches illuminating the city sky. Protesters chanted "We Want Justice" and waved Indian flags during a mass sit-in. The parents of the deceased doctor were compelled to take to the streets, seeking justice for their beloved daughter. The father of the murdered doctor addressed the rally, expressing his family's devastation and shock.


One man was detained for the murder, but the West Bengal government faced criticism for its handling of the investigation and tempering with the postmortem. While protests were peaceful, ruling party supporters repeatedly attempted to intimidate protesters and even violently attacked them. Mamata Banerjee herself mocked the CBI inquiry, that had been ordered by the honorable High Court. The Supreme Court ordered a national task force to examine security for healthcare workers, stating that the killing "shocked the conscience of the nation". The attack drew comparisons with the 2012 Delhi bus gang rape and murder, which led to a change in government.


 It is essential that people across India, led by doctors, maintain the momentum in solidarity to teach a lesson to the tyrannical elements in government. It may not be appropriate to continue with continuous strikes across the rest of India at this stage. However, it is necessary to organize monthly or weekly solidarity protests with the participation of the general public, professional bodies, and students. This will help send a strong signal to the perpetrators and their powerful supporters. The obstinate stance of the Mamta Banerjee government, the destruction of evidence, and violent attacks on protesters are unacceptable. The national outrage, repeated reprimands by constitutional heads, Supreme Court, High Court, and media outcry demand a response. The people's movement must persist in demanding justice and safety for women, holding those in power accountable.

- Leaders and masterminds behind these violent acts must be held accountable and brought to justice to prevent further bloodshed and genocide of native populations, particularly weaker sections like SC/ST.

- Proactive measures are necessary to prevent radicalization and promote social cohesion, inclusivity, and harmony.

- Continuous monitoring and surveillance of potential hotspots and individuals vulnerable to radicalization is vital to prevent violence and ensure public safety.

- Community engagement and participation in deradicalization efforts are crucial to address the root causes of extremism and promote social cohesion. 

- Deradicalization, Rehabilitation and reintegration programs for lesser radicalized individuals or first timers, among those involved in communal violence are essential to prevent recidivism and promote social harmony. Help should be taken of ex-muslims through online and offline programs and deradicalization experts like Subuhi Khan, Ashwani Upadhyay, Shankar Sharan. It's better to have a centre or chair, if not a university dedicated to this.

Strict legal action against those involved in communal violence, hate speeches, and radicalization is necessary to deter others and ensure justice for victims.

- International cooperation and intelligence sharing are vital to combat global extremist networks and prevent the spread of radical ideologies.

- Policy reforms and legislative measures are necessary to address the root causes of radicalization and communal violence, and to promote social cohesion and inclusivity.

India's Immigration Conundrum: A Call to Action


India should be vigilant about the immigration crisis from Bangladesh. They are responsible for managing their own country if it is indeed their country. If they cannot do so, they should not demographically spoil India. If it is not their legitimate country and has been snatched through deceitful and fraudulent means of the Two Nation Theory, then they should return it to India.

Background:

The Two Nation Theory, proposed by Muhammad Ali Jinnah, led to the partition of India in 1947, resulting in the creation of Pakistan. However, this theory was based on deceit and has led to numerous conflicts and atrocities against minorities, particularly Hindus and Bengalis. While two Islamic states with begging bowls are littering the right and the left flanks of truncated India, much promised homeland and freedom to Hindus is nowhere in sight!

1971 Liberation War:

In 1971, Bangladesh liberated itself from Pakistan after facing brutal atrocities, including mass killings, rapes, and displacement. The Mukti Bahini, a Bangladeshi guerrilla force, played a crucial role in this liberation struggle. India provided significant support to the Mukti Bahini, leading to the eventual defeat of Pakistani troops.

Immigration to India:

Since 1947, there has been a steady influx of immigrants from East Pakistan-Bangladesh to India, with a significant spike in 1971. This has continued unabated till 2024, with many Bangladeshis entering India illegally or overstaying their visas. This has put a strain on India's resources and has led to demographic changes in various regions.

Concerns:

Given the historical context of the Two Nation Theory and the atrocities committed by Pakistan, India needs to be cautious about the immigration crisis from Bangladesh. It is essential to ensure that India's security and integrity are not compromised by allowing unchecked immigration. The onus lies on Bangladesh to manage its own affairs and preventing its citizens from seeking refuge in India.
