Distinction between criminals on the basis age is making minors more vulnerable

भारत में अपराध करने वाले किसी किशोर को कानून की नज़र में वयस्क माना जाए या नाबालिग? निर्भया के सामूहिक बलात्कार और हत्या के दोषियों में से एक, अपराध के समय 17 साल का था और उसकी रिहाई पर हो रही बहस कितनी वाजिब है. इस सारी बहस के पीछे है डर. इस मामले में अनुभव ये है कि सामूहिक बलात्कार, सांप्रदायिक हिंसा (communal hate crimes) love jihad, दंगा (Riot) या हत्या जैसा जघन्य अपराध का दोषी अगर 16-17 साल का भी है तो वह किसी वयस्क से कम नहीं. ऐसा किशोर ना सिर्फ कड़ी सज़ा का हक़दार है बल्कि सज़ा ख़त्म होने के बाद उसके दोबारा अपराध करने कि गुंजाइश भी है.

Even more worrying is that major criminals, gangsters, and religious fanatics are changing their modus operandi and investing and relying heavily on capturing the minors and their mind space while young. The relaxation of minors in case of crimes has boomeranged and proved counter-productive and should be immediately done away with.
